Terms & Conditions

These Terms & Conditions govern your use of the Evaan Vacation website and services. By accessing or using our website, booking tours, or enrolling in the Travellers Community Program, you agree to abide by these rules. We may collect information from users to provide seamless services, and for support or reference purposes. Sensitive information is securely discarded once the purpose is fulfilled. If you do not agree with these terms, please refrain from using our website or services.


1. Services

1.1 Our services include destination planning, itinerary customization, transportation booking, accommodation reservations, visa and documentation assistance, and related travel facilitation.


2. Travellers Community Program

2.1 Enrolment
By enrolling in the Travellers Community Program, you agree to abide by these Terms & Conditions.

2.2 Application & Fees
Applications must include valid proof of identity and address. Program fees are payable via Cheque, Credit/Debit Card, Internet Banking, or UPI to Evaan Vacation at the location where the enrolment is finalized.

2.3 Program Benefits
Program members can book holidays based on their chosen plan. All bookings are subject to availability. Requests should be sent to our booking team 30–45 days prior to the scheduled holiday.

2.4 Program Cancellation
If full payment is not made within the stipulated timeframe, your enrolment may be cancelled automatically.

2.5 Transfer of Enrolment
The program benefits are valid for a specified period and are transferable only after full payment has been made.

2.6 Community ID Generation
Membership IDs will be generated within 30 days from the date of enrolment.


3. Booking and Payment

3.1 Reservation Confirmation
Upon booking a tour, a confirmation email will be sent to your registered email address.

3.2 Payment Policy
A non-refundable advance payment is required at the time of booking.

3.3 Balance Payment
Remaining payments must be made as per the schedule provided. Failure to pay on time may result in cancellation of the booking.


4. Cancellation and Refunds

4.1 By Travellers
Cancellations must be submitted in writing within the stipulated timeframe. Refund eligibility will depend on the cancellation date and applicable plan terms.

4.2 By Evaan Vacation
Evaan Vacation reserves the right to cancel tours due to natural disasters, political unrest, insufficient bookings, or other events beyond our control. In such cases, members may choose between a full refund or an alternative tour. Any additional costs for alternative arrangements will be borne by the traveller.


5. Hotel Accommodations

5.1 Third-Party Ownership & Commissions
Hotels, resorts, and homestays are owned and operated by third parties. Evaan Vacation acts solely as an intermediary and earns commissions for successfully facilitating bookings.

5.2 Quality Assurance
While we strive to ensure accommodations meet acceptable standards, Evaan Vacation shall not be held liable for disputes arising during your stay. Any complaints should be addressed directly to the hotel or accommodation management.


6. Travel Documentation & Insurance

6.1 Passport & Visa
Travellers are responsible for ensuring they carry valid passports, visas, and other required travel documents for their booked trips.

6.2 Travel Insurance
We strongly recommend travel insurance to cover cancellations, medical emergencies, or loss of personal belongings. Evaan Vacation shall not be liable for unforeseen losses.


7. Liability

7.1 Limitation of Liability
Evaan Vacation shall not be responsible for losses, damages, or injuries arising from events beyond its control, including but not limited to natural disasters, strikes, terrorism, or transportation delays.

7.2 Third-Party Liability
Evaan Vacation is not liable for services provided by third-party vendors, including accommodations, transportation providers, or local guides.


8. Changes to Itinerary & Services

8.1 Evaan Vacation reserves the right to modify itineraries, accommodations, or services when necessary to ensure safety, comfort, or an improved travel experience.


9. Governing Law and Dispute Resolution

9.1 Any disputes arising from the Travellers Community Program or services shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

9.2 The award passed by the arbitrator shall be final and binding on all parties.

9.3 Courts in Delhi, India, shall have exclusive jurisdiction over any legal proceedings not resolved through arbitration.


10. Miscellaneous

10.1 Force Majeure
Evaan Vacation shall not be liable for delays, cancellations, or failures caused by natural disasters, acts of God, political unrest, pandemics, or other unforeseen events.

10.2 Amendments
These Terms & Conditions may be updated periodically. Continued use of our services constitutes acceptance of the revised terms.

10.3 Acknowledgment
By enrolling in the Travellers Community Program or booking tours with Evaan Vacation, you confirm that you have read, understood, and agreed to these Terms & Conditions.
